Maryland Pool Fencing Requirements for 2018

However, pool safety is of utmost importance and Maryland has certain regulations in place to ensure the safety of pool owners and their neighbors.
Pool enclosure regulations vary slightly from county to county in Maryland, but there are some standards that remain the same across all counties.
Let’s look at those pool fencing requirements in Maryland, and how to best comply with them.
Fencing Basic Requirements
In Maryland, a fence is required to be around any pool deeper than 18 inches.
This fence must be a minimum of 48 inches (taller in some counties) and must completely surround the pool.
This law is in place to prevent children or pets from accidentally entering the pool, but also ensures the pool is secure.
Fencing Construction Requirements
As noted above, all fencing must be a minimum of 48 inches, unless specifically noted higher in your particular county.
The fencing must have pickets no more than four inches apart, to prevent children from getting through the fence.
The fence should be no more than two inches off the ground. Additionally the fence must have self closing gates, to prevent it being accidentally left open.
In most counties in Maryland, the size of the fence will require you to get a permit before you can build it.
Above Ground Pools
Above ground pools are slightly different than in ground pools, and therefore their regulations are different.
Above ground pools that are four feet or higher above ground do not need a fence, so long as their ladder can be detached when not in use.
An exception to this however, is if the pool has a deck on any side of it. In this case, a fence is necessary.
